Recent Fantasy Games

Here's a question: what recent (2000 or later) fantasy RPGs have been released without the benefit of the OGL, but are nevertheless very close to D&D?

Hackmaster's a special case, of course. It was licensed through WotC, even though it wasn't under the open Game License. I'm curious how close a commercial game has come to some version of D&D without either using the OGL or running into legal problems.
